These Terms of Use constitute a legally binding agreement between you (“you”) and Tapnetic LLC (“Company”, “we”, “us”, “our”) concerning your access to and use of the AI SmartFarm mobile application and website at europesmartfarm.com (together, the “Services”). By accessing the Services, you agree to be bound by these Terms. If you do not agree, discontinue use immediately.
Agreement to Terms
We may update these Terms at any time. We will alert you by updating the “Last updated” date. Your continued use after changes are posted constitutes acceptance of the revised Terms.
Intellectual Property Rights
The Services, including all source code, databases, functionality, software, designs, text, photographs, and graphics (the “Content”) and the trademarks, service marks, and logos (the “Marks”), are owned or controlled by us and protected by applicable laws. You may not copy, reproduce, aggregate, republish, upload, post, distribute, sell, or commercially exploit any part of the Services without our prior written permission.
User Representations
By using the Services you represent that: (1) all registration information you submit is true, accurate, current, and complete; (2) you will maintain its accuracy; (3) you have legal capacity and agree to comply with these Terms; (4) you are at least 18 years old; (5) you will not access the Services through automated means; (6) you will not use the Services for any illegal or unauthorized purpose; and (7) your use will not violate any applicable law.
User Registration
You may be required to register. You agree to keep your account credentials confidential and are responsible for all use of your account.
Fees and Payment
We accept Apple Pay, Google Play, and Paddle. You may purchase a subscription to access some features. You agree to provide current, complete, and accurate purchase and account information and to promptly update it. You authorize us to charge your chosen payment provider for all amounts due. If your purchase is subject to recurring charges, you consent to recurring billing until you cancel. We may change prices at any time and may correct pricing errors even after payment. Free Trial
We may offer a free trial to new users. Accounts are charged according to the chosen subscription when the trial ends, unless you cancel beforehand.
Cancellation
You can cancel your subscription at any time in the App Store, Google Play, or your account settings. Cancellation takes effect at the end of the current paid term. If you are unsatisfied, email mail@tapnetic.ai.
Software
We grant you a non-exclusive, revocable, personal, non-transferable license to use the software solely in connection with the Services and these Terms. Software is provided “as is” without warranties of any kind.
Prohibited Activities
You may not use the Services to: break security features; trick or defraud us or other users; misuse support; use scripts, bots, or scrapers; reverse engineer or decompile the software; attempt to bypass access restrictions; harass our team; remove proprietary notices; transmit viruses or harmful material; or use the Services inconsistently with applicable law.
User-Generated Contributions
You retain ownership of the farm records, photos, notes, and other content you submit (“Contributions”). You grant us a limited license to process your Contributions solely to provide the Services, including generating exports and reports for you, in accordance with our Privacy Policy.
Mobile Application License
If you access the Services via a mobile app, we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the app on devices you own or control, in accordance with these Terms and the applicable App Distributor’s terms (Apple App Store or Google Play).
Submissions & Feedback
Feedback or suggestions you provide are non-confidential and may be used by us without compensation.
Site Management
We reserve the right to monitor the Services, take action against violations, restrict access, remove content, and otherwise manage the Services to protect our rights and facilitate proper functioning.
Privacy Policy
By using the Services you agree to our Privacy Policy, incorporated into these Terms by reference.
Term and Termination
These Terms remain in effect while you use the Services. We may terminate or suspend your access at any time, without notice, for any reason, including breach of these Terms.
Modifications and Interruptions
We may change, modify, or discontinue the Services at any time without notice and are not liable for any resulting loss, damage, or inconvenience.
Governing Law
These Terms are governed by the laws of Armenia. You irrevocably consent that the courts of Armenia have exclusive jurisdiction over any dispute arising from these Terms.
Disclaimer
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF AGRONOMIC ALERTS, EXPORTS, OR PROFITABILITY INSIGHTS, WHICH ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE AGRONOMIC, VETERINARY, OR FINANCIAL ADVICE.
Limitations of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profit or data, arising from your use of the Services. Our total liability is limited to the amount you paid us in the six months preceding the claim.
Indemnification
You agree to defend, indemnify, and hold us harmless from claims arising out of your use of the Services, breach of these Terms, or violation of third-party rights.
User Data
We maintain data you transmit to provide the Services. You are responsible for backing up your farm data. We are not liable for loss or corruption of your data beyond what is required by law.
Miscellaneous
These Terms are the entire agreement between us. Our failure to enforce a right is not a waiver. If a provision is found unenforceable, the rest remain in effect.
